Law Suits against
Womancare and Dr. Alberto Hodari
Please keep in mind that the women obtaining termination services are often required to sign a document stating that they will not hold the clinic/doctors/staff responsible for injuries obtained during their care. Although this document will not stand in a court of law, if a woman experiences malpractice, many women assume that they do not have a right to take legal action nor have the monetary means to look into legal action.
Does any woman deserve to be treated like these women? Would you send someone you love to him for his services?
Two women not included in list are:
Tamia Russell, age 15, died less than 24hrs after obtaining an abortion in Jan 2004 at Womancare of Southfield/Lathrup Villiage. Her guardian did not know she was pregnant, let alone going in for an abortion. Her 26 yr old boyfriend paid $2,000 cash (requested by Hodari) for a 26+ week old abortion to be performed on Tamia.
17yr old girl died in October 2007 as a result of abortion related causes the day after obtaining an abortion at Womancare of Downriver/Southgate. At the time of her death, her parents did not know she had ever been pregnant let alone had an abortion.

Dilatation and suction abortion performed approx 11:30am, patient discharged approx 1:10pm even though she complained of stomach and chest pains. A short time after returning home, she was found unresponsive. Patient was pronounced dead at 5:17pm, same day of abortion.

Former employee filed a PPO against Hodari after he sexually assaulted her at the clinic. After she resigned, he would often call her at home, stay on the line and say nothing. Also had his employees calling her.
98-009981-NH FRIEDMAN
Experienced sexual assault, at time of abortion for a “normal” intrauterine pregnancy. It was later discovered in a local hospital’s ER, after rupturing, to be a misdiagnosed ectopic pregnancy. (Fatal if not treated)

Patient suffered respiratory/cardiac arrest following her abortion. Clinic failed to assist her or call for an ambulance. Oxygen was deprived for an extended period of time. She died shortly after.

Lamp, illuminating the procedure, fell on the patient; burning her thigh.
07-084731-NH STALLINGS
In a week’s time, at 8 weeks pregnant, patient underwent two separate termination procedures by Hodari. Eight days after the 2nd/repeated “successful” termination, the patient ended up in the hospital with a misdiagnosed ectopic pregnancy. (Fatal if not treated immediately after rupturing)

Woman obtained an abortion at Womancare. Nine months later, she requested to review her own personal file and medical records. Womancare refused to allow her, and also turned down her request for copies.

Woman went to Womancare to be treated for an 8 week pregnancy (abortion?). There she informed the doctor that she had discovered a lump in her right breast. The doctor failed to follow up with any further testing, nor treatment of any kind. Two months later, Ellen wound up in the hospital (tumor grew rapidly and spread to her lympnodes) and was forced to have her right breast removed.

Womancare breeched rental contract and owed plantiff $28,977.73 in past rent.
Underwent D&C termination, made numerous calls reporting severe abdominal pain and nausea but was ignored. Two weeks later, after being hospitalized, perforations on her uterus and small bowel were discovered. Required reconstructive surgery on her bowels and uterus. Spent two weeks in hospital.
96-514732-NH MARSHALL
D&E at 17 weeks, blood pressure dropped and uterus was packed in hopes to slow down the bleeding. Even though the doctor was informed 3 times of her serious condition, it took him 5 hours to return to the clinic to examine her. He then arranged for the patient’s admittance to a nearby hospital and had her transported to the hospital, in not an ambulance, but a SUV. She suffered from a perforated uterus with right broad ligament dissection, and retroperitoneal hematoma. She required reconstructive surgery, removal of damaged fallopian tube and ovary, and blood transfusions.

Obtained 1st tri termination only to suffer, more than 2 weeks later, from a ruptured ectopic pregnancy. (Fatal if not treated immediately) Three days after the tube removal, she received a letter from Womancare informing her of an abnormal pathology findings from her abortion. It took them 3 weeks to inform her.

Obtained birth control at clinic and still ended up getting pregnant. Sought abortion of 17-19 week old fetus. Improperly performed abortion ended up perforating her uterus and uterine wall, causing serious health problems which required multiple surgical procedures to correct. Also required additional help for emotional trauma from counselors, psychologist, and psychiatrist.

22 year old girl was nine weeks pregnant at time of abortion. She experienced heavy bleeding and went into shock after Hodari punctured her uterus during a dilation and suction procedure. ER doctor ruled the wound (3cm) was beyond repair and she was forced to undergo a hysterectomy to save her life.
85-515366-NM Kellogg
Not seeking abortion, but needed care for her unborn child who was experiencing fetal heart distress. Hodari was contacted several times and informed of the worsening and critical condition of the fetus, but failed to attend to the child. The male child was later born dead due to the negligence and malpractice of Hodari.
85-529757-NM Stanton
Female child was born after a botched saline abortion. Dr. Enrique Gerbi, who performed the failed abortion on the infant, left her to die at the Womancare clinic. Because of the acid-like substance (saline) used during her termination, she suffered blindness (eyes were burned up), severe scaring, burns on her hands and feet, mental retardation, and heart surgery was also required. Hodari held responsible for employing Gerbi although he held 11 malpractice suits at the time.

Obtained suction abortion around Christmas, in late April it was discovered that she was still pregnant after she was hospitalized for stomach cramps. A D and C was performed and removed the fetus. She may have lost her fertility in the process. Clinc also failed to obtain informed consent from girl at the time of 1st abortion, did not maintain adequate records regarding her care.

Woman went to clinic to have IUD removed on 5/10/84. On 5/27/84, she experienced bleeding and pain. An ultrasound administer at Wyandotte Hospital revealed on 6/4/84 revealed that her IUD was still in place.

Obtained suction abortion. After the procedure, woman experienced severe pain on her right side, felt dizzy, had chills, and passed out at clinic. She was sent home in this condition, only to end up at Riverview Hospital later that night. Diagnosed with a large retroperitoneal hematoma and a perforated uterus. (2 liters of blood were located in uterine cavity) Required subsequent surgeries to correct.

Obtained a late-term abortion at 23 weeks pregnant. Laminaria was inserted on 6/14/94 and 6/15/94 to force open the cervix. 6/16/94 Pamela began to experience severe abdominal cramping and weakness at home. The same day, she returned to Womancare for the abortion. (They noted her weakness and the great deal of pain she was in) The laminaria was removed and the abortion was performed. Several hours after the abortion, Pamela continued to experience severe cramping. She then went to Mercy Hospital and was diagnosed with a full thickness 8 cm laceration on her uterus and colon/bowel. She was required to undergo an immediate hysterectomy as well as colon repair.

Botched saline abortion. Aborted male child was born alive at 27 weeks, 1lb 13oz, 13 ½ inches Because of the 20% saline solution (acid-like substance) that was used for his failed termination, he suffered respiratory distress, sustained brain injury and other severe bodily injuries and burns.

Obtained an abortion on Oct 19, 2002 at 10:45am, 11:30am was in recovery, 11:50am found unconscious in restroom, 12:30pm staff left her outside (after she was dressed) while they went to lunch for about an hour. Lakeeta was still nauseated, dizzy, suffering abdominal pain, and had a feeling of numbness. After returning from lunch, staff escorted her to a nearby business for a ride home. She was not evaluated pre or post procedure, vitals were not checked, she was not monitored for adverse effects from abortion surgery. Back home in Toledo, she continued to experience symptoms and was taken to St. Luke Toledo hospital at 4:30pm, later the same day. She was given antibiotics and treatment for rehydration. She was released the following day. Lakeeta Streeter’s paperwork at Womancare demonstrated emissions of times, lack of documentation of patient data, appropriate oversight during administration of anesthesia, contained overwritten and illegible notes regarding gestation age of fetus, fluid and medication administration. Plain sheet of paper said she exited and refused to reenter building. No identification of time or patient discharge status… simply read “Good” by Dr. Hodari.
